Terms and Conditions of Online Payment

These Terms and Conditions of Online Payment (the "Terms") govern all payments made through the website www.igo.ae (the "Website") to Invest Group Overseas (L.L.C), a limited liability company incorporated in the Emirate of Dubai, United Arab Emirates, holding Commercial Licence No. 572835 issued by the Dubai Department of Economy and Tourism and registered in the Commercial Register under No. 75990, together with its branch DIGO Real Estate Development (Licence No. 767971), with its office at Office No. 01, The Paragon by IGO Building, Business Bay, Dubai, P.O. Box 96844 ("Invest Group", "we", "us" or "our"). Invest Group is engaged, among other licensed activities, in the business of real estate development.

By making a payment through the Website, you ("you", "your", the "Customer" or the "Cardholder") confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy and any other policies published on the Website. If you do not agree with these Terms, please do not use the Website to make a payment.

The United Arab Emirates is our country of domicile.

"Unit" means any residential, commercial or other real estate unit, plot or property developed, marketed or sold by Invest Group.

"Reservation Form" means the booking, reservation or expression-of-interest form signed by the Customer in respect of a Unit.

"SPA" means the Sale and Purchase Agreement (or any equivalent agreement) entered into between Invest Group and the Customer in respect of a Unit.

"Payment Gateway" means the third-party online payment service provider appointed by Invest Group to process card payments made through the Website.

Payments through the Website may only be made by persons who are at least eighteen (18) years of age and have full legal capacity to enter into binding contracts. Minors under the age of 18 are prohibited from registering as users of the Website or making any payment through it.

You confirm that you are the authorised holder of the card used for payment, or that you have the express authority of the cardholder to use it, and that all information you provide is true, accurate, current and complete.

The Website may be used to make the following payments to Invest Group, as applicable:

• Reservation or booking deposits for a Unit;
• Down payments and scheduled instalments due under an SPA;
• Administration, transfer, amendment, or No-Objection Certificate (NOC) fees;
• Handover fees, and other charges payable to Invest Group; and
• Any other amount that Invest Group confirms in writing may be paid online.

Where a payment includes fees collected on behalf of a government authority or third party (for example, property registration fees), those amounts are subject to the rules and refund policies of that authority or third party.

Invest Group may, at its discretion, set limits on the amount that may be paid online in a single transaction, or require certain payments to be made by bank transfer, cheque or other approved method.

These Terms govern only the online payment process. The sale of any Unit, payment schedules, amounts due, late-payment consequences, cancellation rights and refunds relating to a Unit are governed by the relevant Reservation Form, the SPA and applicable law.

In the event of any conflict between these Terms and the Reservation Form or SPA, the Reservation Form or SPA (as applicable) shall prevail.

Making a payment through the Website does not by itself create a binding agreement for the sale of a Unit, nor does it guarantee the reservation or allocation of any Unit, unless confirmed by Invest Group in writing.

We accept online payments using Visa and MasterCard credit, debit cards, Apple pay and Samsung pay in UAE Dirhams (AED).

All amounts displayed on the Website are in AED unless otherwise stated. If your card is denominated in another currency, the exchange rate and any foreign-transaction fees will be determined by your card issuer, and Invest Group is not responsible for any difference in the amount charged to your card.

Any bank charges, card-issuer fees or other charges imposed by your bank are your responsibility. Where applicable, Value Added Tax (VAT) will be charged in accordance with UAE tax law and shown on your invoice or receipt.

All card payments are processed securely by our Payment Gateway using industry-standard encryption. Your payment may be subject to additional authentication (such as 3-D Secure / one-time password verification) by your card issuer.

Invest Group does not store card details. Card details are handled directly by the Payment Gateway in accordance with the Payment Card Industry Data Security Standard (PCI DSS). Invest Group may process and share other personal and transaction information only as described in Section 13.

While we take reasonable measures to protect the Website and your information, we cannot guarantee that transmissions over the internet are completely secure, and you use the Website at your own risk.

Once your payment is successfully processed, you will receive an on-screen confirmation and a confirmation email to the email address you provided. An official receipt will be issued by Invest Group within Five working days.

A payment is considered received by Invest Group only once the funds have been cleared and credited to Invest Group's account.

Please quote your Unit number, SPA/reservation reference and full name when making a payment. Invest Group will allocate payments against the amounts due under your SPA, and may allocate any payment first towards outstanding fees, charges or penalties in accordance with the SPA.

The Cardholder should retain a copy of transaction records and of these Terms for future reference.

Invest Group is not liable for any payment that is declined, delayed or not completed due to insufficient funds, card issuer restrictions, technical failures, incorrect information provided by you or any other reason.

If your card has been debited but you have not received a confirmation, please contact us at finance@igo.ae before attempting another payment. Duplicate or erroneous payments, once verified, will be refunded to the original card in accordance with Section 10.

Cancellations and refunds relating to a Unit are governed exclusively by the Reservation Form, the SPA and applicable law. Unless stated otherwise in those documents, reservation deposits and administration fees are non-refundable.

Any approved refund will be made only through the original mode of payment, to the same card used for the original transaction. Refunds will not be made in cash or to a different card or account, except where required by law or at Invest Group's sole discretion.

Approved refunds will be initiated within 30 days of approval. The time taken for the refund to appear on your statement depends on your card issuer and may take an additional Five to Fifteen working days.

Refunds may be subject to deductions permitted under the Reservation Form, the SPA or applicable law, and any bank or processing charges incurred will not be refunded. Where exchange-rate fluctuations apply, Invest Group is not liable for any difference in the amount refunded.

Requests for cancellation or refund must be submitted in writing to finance@igo.ae, stating your full name, Unit number, reference number, transaction date and amount.

If you have a query about a payment, please contact us first so that we can try to resolve it promptly. Raising a chargeback with your bank without first contacting us may delay resolution.

Invest Group reserves the right to dispute any chargeback it considers unjustified, and to recover any amounts, fees and costs arising from unjustified or fraudulent chargebacks. A chargeback does not release you from your payment obligations under the SPA.

Invest Group complies with UAE anti-money laundering and counter-terrorist financing laws, including Federal Decree-Law No. 20 of 2018 and its implementing regulations, as amended. We may request identification or other documents to verify your identity, the source of funds, or the relationship between the payer and the purchaser.

Invest Group may refuse, suspend, hold or return any payment that it reasonably suspects to be fraudulent, unlawful or not in compliance with applicable law, including payments made by third parties who are not party to the relevant Reservation Form or SPA, without liability to you.

We will not trade with or provide services to any person, entity or jurisdiction where doing so would violate sanctions applicable to Invest Group under the laws of the United Arab Emirates, United Nations Security Council resolutions or any other sanctions regime that is legally binding on Invest Group.

Personal information collected in connection with a payment (such as your name, contact details and transaction information) is used to process your payment, issue receipts, manage your account and meet our legal and regulatory obligations. It is handled in accordance with our Privacy Policy and applicable UAE data protection law, including Federal Decree-Law No. 45 of 2021.

We may share your information with our Payment Gateway, banks, escrow agents, professional advisers and government or regulatory authorities where necessary for these purposes or where required by law.

To the maximum extent permitted by law, Invest Group shall not be liable for any indirect, incidental or consequential loss or damage arising from the use of the Website or the online payment facility, including any interruption, delay, error or unavailability of the Website or Payment Gateway.

Information on the Website, including project details, prices, images and payment plans, is provided for general information only and does not constitute an offer. Invest Group may change such information at any time without notice.

Invest Group may amend these Terms at any time by publishing the updated version on the Website. The updated Terms will apply to payments made after the date of publication. You are encouraged to review these Terms each time you make a payment.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai.

Any dispute or claim arising out of or in connection with these Terms or the Website shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, United Arab Emirates, save where the Reservation Form or SPA provides otherwise.
